LAKEPORT ? On May 5, Wallace “Nick” Himmer, age 47, pleaded guilty to two felony counts of committing lewd and lascivious acts a minor under the age of 14, in violation of Penal Code section 288(a), and one felony count of exhibiting harmful or obscene matter to a minor, in violation of Penal Code section 288.2.
The defendant also admitted all special allegations included in the complaint, including that the illegal activity amounted to “substantial sexual conduct.” Himmer”s victim is now 8 years old.
Superior Court Judge Richard Martin will sentence Himmer on June 6.
Since his arrest on Jan. 23, Himmer has been held in custody with bail set in the amount of $150,000.
Two of the three felonies to which the defendant pleaded guilty are “violent felonies” and therefore “strikes” pursuant to California Penal Code. He faces a potential 10 years and 4 months in state prison, should the court elect to impose the maximum sentence in this case. Due to the nature of the crimes, Himmer also will be required to register as a sex offender for the remainder of his life.
