LAKEPORT Lucerne resident Wallace “Nick” Himmer, who pleaded guilty to two felony counts of child sexual abuse on May 5, was given the maximum sentence Friday and will spend 10 years and eight months behind bars.
On May 5, Himmer, 47, pleaded guilty to two felony counts of committing lewd and lascivious acts with a minor under the age of 14 and one felony count of exhibiting harmful or obscene matter to a minor.
The female victim is currently 9 years old.
Himmer also admitted to all special allegations in the complaint, including that the illegal activity amounted to “substantial sexual conduct,” which includes the ongoing nature of his crimes.
“He admitted to committing these acts between January 2003 through January 2006,” prosecuting Deputy District Attorney John DeChaine said Friday.
“It was an especially egregious case,” DeChaine said. “The victim had certain disabilities that made her particularly vulnerable. For that reason, it was important that the defendant take full responsibility for what he did.”
Judge Richard Martin imposed the maximum prison sentence available under the law, DeChaine stated in a recent release. The defendant was sentenced to the upper prison term for each law violation, for a total prison sentence of 10 years, eight months.
Because two of the three felony counts are “violent strikes,” Himmer will be required to spend at least 85 percent of the sentence in prison before he can qualify for parole.
“The Sheriff”s Department moved in quickly on this case,” DeChaine said. “The investigation continued with numerous detectives assigned, then the case went to detective Mike Curran, whom I worked closely with to achieve these results.”
Himmer will be required to register as a sex offender for the remainder of his life.
