LAKEPORT A 36-year-old Bay Area man, who was allegedly distraught over the recent death of his wife, was arrested Tuesday afternoon only after he was subdued with a Taser.

A Richmond resident, Andres Apodaca, was charged with two misdemeanors obstructing, resisting and delaying an officer and public intoxication. He was transported to the Lake County Hill Road facility.

Chapel of the Lakes Mortuary personnel called the sheriff”s dispatch center Tuesday afternoon because Apodaca allegedly was causing problems at their facility. They reported he had had been drinking. Shortly after the call, Apodaca left the mortuary in his 2005 Chevy pickup truck.

A short time later, sheriff”s deputy Brian Martin located the truck in the Shoreline Shopping Center parking lot and saw Apodaca enter the Dollar Store. Martin stopped and made contact with Apodaca to check his welfare and make sure he had not been operating a motor vehicle while under the influence of any alcoholic beverage. Together they walked out of the Dollar Store. Martin inquired how much Apodaca had been drinking and if he had just been driving.

According to the sheriff”s department press release, Apodaca started making statements such as “Uh let me see … I think someone else was driving. Don”t touch me … if you lay your hands on me we”re gonna have problems bro.” While making these statements, Andy Apodaca was breathing harder and clenching his jaw and fists. He then removed his sunglasses as he assumed a fighting stance directed towards Deputy Martin. At this point, Martin told Apodaca he was under arrest for public intoxication, directing him to place his hands behind his back.

However, Apodaca attempted to re-enter the Dollar Store and after nine verbal commands to submit to the arrest, Martin withdrew his Taser again informing Andy Apodaca to submit to the arrest. With no compliance, Martin deployed the Taser, which had an immediate effect. Apodaca was taken into custody without further incident.
