I received the governor”s flier on Proposition 83 (sexual predators).
The effects of this is longer prison sentences, keeping predators from living within 2,000 feet of schools and parks. They also cannot be within the same 2,000 feet of schools or parks, ever.
This proposed law should be limited to felony convictions. Misdemeanor convictions cannot even be listed on the Megan”s Law Web site. So this 2,000 feet (and ankle bracelets) is unconstitutional if expanded to non-predatory convictions (misdemeanors that don”t involve exhibitionist, sexual or lewd acts). These are not intentional actions, not requiring prison or ankle bracelets, but still the current 1,000-foot distance from schools and parks (the 1,000-foot distance is sufficient for non-predatory misdemeanor convictions.
