CLEARLAKE — Roy Hinkle Johns, 33 of Middletown was sentenced to 12 years in prison on Thursday Superior Court Judge Stephen O. Hedstrom also cited aggravating circumstances and ordered Johns to pay a fine of $2,600.
According to the Lake County Sheriff”s investigation, on Aug. 17, 2006 Johns entered the Middletown Pharmacy and demanded OxyContin from a female store employee. Johns pulled out a small handgun and advised that he was serious. The female employee fled to a back room calling for help. Johns pursued her and tried to push his way through a door where other employees had come to her aid. Pointing the gun and yelling, “Don”t make me shoot you,” The employees managed to close the door. Johns fled the store without the OxyContin he demanded.
According to the report, Johns was arrested the next day by the LCSD in Lakeport at North Lake Medical Pharmacy trying to have a prescription for OxyCotin filled. The gun was not recovered.
On Nov. 13, Johns pled guilty to attempted robbery and admitted that he used a firearm. He faced a maximum prison term of 13 years.
At sentencing, the defense asked Judge Hedstrom to impose a lower term of five years citing that Johns had a minimal criminal record and that Johns had become addicted to OxyCotin after injuries sustained in an auto accident. Prosecutor Richard Hinchcliff asked for the upper term, citing Johns had pre-planned the robbery.
Because the crime is classified as a violent crime, Johns is required to serve 85 percent of the time imposed. He will be eligible for parole in 2016.
