LAKEPORT — After three days of testimony by both parties, Judge Richard C. Martin determined Tuesday that there is sufficient evidence to proceed on all counts against former Lakeport Police Officer Richard Erickson.

In making this determination, Judge Martin used the “probable cause” legal standard. The prosecution must still show evidence that convinces a jury beyond a reasonable doubt that Erickson is guilty of the charges.

Erickson, an 11-year-veteran, is charged with felony misappropriation of government funds, stalking and making terrorist threats. He is also charged with one misdemeanor count of violating a restraining order. Erickson has pleaded innocent to all counts.

According to testimony given during the past three days, Erickson attended to personal business while on duty, which included having sex in his police car, and used company time to work on his home.

“I am not questioning the morality of the defendant”s actions while on duty,” said Judge Martin. “I think the taxpayers would resent any tending to personal business while on duty.”

Erickson returns to court 8:15 a.m., Feb. 3. in Dept. 3.
