The Clearlake City Council will continue a Public Hearing on Thursday, Feb. 8 regarding an appeal denying a request for a deferral in the requirement for sidewalk installation on Burns Valley Road. The council requested a continuance in order to gain clarification on the issue.

The appeal was brought forth by Thomas Snyder, who is currently requesting the minor subdivision of a 32-plus acre thereby lot creating four parcels of varied sizes. The request for subdividing the lot was granted by the Planning Commission on Oct. 16, 2006; however, the commission had denied Snyders request to defer the sidewalk installation requirement.

The project site is located on Burns Valley Road, east of Sonoma Way and north of Olympic Drive. Snyder is not requesting deferral for requirements of curb, gutter, drainage and paving improvements. He is however, requesting deferral for sidewalk installation because there is no existing sidewalks adjacent to his project site and the sidewalk would be a piecemeal improvement.

When the item was heard by the Planning Commission in October, according to the minutes of the meeting, Hamid Heidary, who had represented the applicant, had claimed that no other sidewalk exists within 2 miles of the project. However, on-site calculations by Clear Lake Observer?American staff determined that the sidewalk fronting the Redbud Library, which is located on the same side of the road, is only about four/tenths of a mile southeast from Snyders project site.

City Staff is recommending denial of Snyders request in effort to maintain consistency in implementing construction standards for new development.

Development of land located between the library and the Snyder site is pending. Calvary Baptist Church has plans for future construction, which will also be subject the citys construction standards.
