CLEARLAKE — The Clearlake Police Department (CPD) identified the victim of a Monday night shooting as Clearlake resident Timothy McCarty, 38.

According to a Wednesday CPD press release updating the case, McCarty is in “stable but serious” condition at Santa Rosa Memorial Hospital.

“We haven”t been able to talk to the victim yet. He”s not in a position to be spoken to,” Lt. Mike Hermann of the CPD said Wednesday. Hermann said McCarty was shot at least once in the back.

McCarty was shot several times in his upper torso outside the 40th Avenue home of Noah Michael Parker, who was arrested Tuesday in connection with the shooting. Parker allegedly used a Smith and Wesson 9 mm handgun. A search of his home turned up several spent shell casings, according to the CPD.

Hermann confirmed that Parker fled the scene with his live-in girlfriend, Selena Sargent, 33. The couple was found and arrested at a friend”s house on 28th Street at 4 a.m., following the 9:50 p.m. incident Monday night. Sargent was arrested on suspicion of cultivating and selling marijuana.

Lake County Jail booking staff confirmed that Parker was booked Tuesday afternoon on four felony charges. The charges include attempted murder, felon in possession of a firearm, cultivating marijuana and selling marijuana. Hermann said additional charges may be filed, pending review by the Lake County District Attorney”s Office.

Chief Deputy District Attorney Richard Hinchcliff said he expects to file charges after reviewing police reports today, and that Parker will be arraigned this afternoon.

During a search of Parker”s home, police found marijuana plants, about one and a half pounds of processed marijuana, multiple scales, weights, packaging materials, pay-owe sheets, drug paraphernalia and “other items indicative of illegal sales,” according to the CPD release. Hermann said that what appeared to be methamphetamine residue and items used to ingest the drug were also found.

“Drugs were found in the home, but we have no indication that the incident was drug-related. Right now, we know of no motivation for the shooting, other than that the two men got in an argument,” Hermann said.

The unidentified man who was pulled over with McCarty in his car moments later is not considered a suspect, Police Chief Allan McClain said. Hermann said the man had come to Parker”s house with McCarty.

“The victim wanted to contact Parker about something, and Parker was outside with the victim when an argument or an altercation took place and the shooting happened. The driver of the car wasn”t paying attention. I don”t think he was aware that something was going to happen. He was just in the wrong place at the wrong time,” Hermann said.

The Wednesday CPD press release says Parker is a convicted felon. Hermann could not confirm where Parker was convicted or what the charge was. Lake County Superior Court records show only traffic violations.
