The CLRCA would like to minimize and marginalize the dissent occurring in the Clear Lake Riviera to a few unhappy individuals, but this is not the case.

I have personally talked to dozens of people who don”t feel represented or respected and are not receiving any tangible benefits for their dues. Propaganda put out by local real estate agent Ray Perry working for Country Air Property Service in recent publications, whitewashes the problem homeowners arc having with the HOA. The assumption put forth by him is that lack of involvement on the part of residents is why the Association is operating so poorly.

Do you live in the area, and if you do, have you attended a homeowner”s meeting or “Kangaroo court” hearing and tried to share your opinions and be heard by the current Board of Directors? It doesn”t happen. Also, tell me what, does a homeowner do about lots that have been cleared, who is being fined to the tune of $750.00 per month for not clearing them to the board”s satisfaction, and has their property liened upon by the CLRCA? According to the Davis-Stirling Act, no fine must exceed the cost of correcting the violation. Should this individual want to fight back against this type of treatment and stand up for their rights?

Lastly, the articles go on further to encourage residents to run for any open board seat in the upcoming June ?08 elections as a way of getting involved, However, individuals who have served over their two-year term limits are occupying the leadership positions of President and Vice President and have not acknowledged or answered written requests to justify this disregard of the Association By-Laws Article VI Sec. 1.

These same individuals self-appointed themselves to another term of office through June ?09. Alan Siegel alone has been serving on the board collectively either as Vice President or President for at least 4 years straight. If the leadership is illegitimate, it taints the rest of the Association”s form and function and makes a mockery out of the whole system. How can the board enforce CC&R”s on homeowners, but not uphold its own By-Laws? It is time for a change.
