CLEARLAKE ? The second reading of an ordinance pertaining to the rezoning of the Provinsalia property was continued for the second time Thursday evening. The item was continued to the April 9 regular meeting of the Clearlake City Council.

The second reading of the ordinance, which will rezone the project area located east of Dam Road, was originally carried over from the March 12 meeting at the request of Vice Mayor Judy Thein who asked for a written legal opinion in regard to the conduct of previous public hearing held on the subject.

City Administrator Dale Neiman reported Thursday that the city”s legal representative, Mala Subramanian, was unable to complete the task requested by Thein in time for the March 26 meeting and recommended that the item be continued to the April 9 meeting.

The Provinsalia Project proposes construction of 665 single family/multiple family dwellings in the area east of Dam Road. The project also includes the construction of a golf course, trail system, clubhouse and interpretive center. The project site is 292 acres and has approximately 1.4 acres of waterways, 45.8 acres of land over 30 percent slope, 2.8 acres of valley oak woodland, 18.5 acres of blue oak habitat, 9.2 acres of known cultural resource sites and 31.2 acres comprised of wetlands or Cache Creek. The net developable acreage is 183.1 acres.

In other council action three surplus properties were authorized for sale in accordance with Government Code (GC) Section 37350, which cites: “a city many purchase, lease, receive, hold and enjoy real and personal property, and control and dispose of it for the common benefit.” Pursuant to GC Section 54222, notification was reportedly sent to concerned parties regarding the availability of the properties and given 60 days to bid on them.

None of the agencies were reportedly interested in purchasing the properties.

The following surplus properties were authorized for sale:

?APN No. 040-063-10 authorized for sale to Jessie Johnson in the amount of $3000. The property is described as a 25 by 100 square foot lot adjacent to Ms. Johnson”s property. The city will carry the financing at four percent interest rate over a five year period.

?APN No. 037-354-12 authorized for sale to Peter Shrive in the amount of $5000. The property is described as a seven-foot strip of land that is situated between two lots owned by Mr. Shrive. There are no public facilities on the strip and no one else would have use for the strip, according to the staff report. The third property is described as a portion of Davis Street approximately 10,000 square feet in size.

It was authorized for sale to Jim and Bonnie Poco in the amount of $10,000. According the staff report, the city engineer estimates it would cost $30,000 to create a buildable site on the property.

The property is work $4.00/sq.ft., based on the sale of the water park property in 2006. The final sales price is based on the appraisal amount minus the engineer”s estimate for improvement costs.
