With respect to the lead article of May 9 on the Dinius trial, the motion for a gag order filed by Deputy District Attorney Langan illustrates the poor choice made by that office to prosecute the sailboat crew.

Any review of the circumstances involved can see that there is enough blame to go around for all parties involved. An admittedly speeding motor boat at night, sailboat lights maybe on, maybe off, restricted visibility in darkness, alcohol involved with all parties and questions about law enforcement procedures make this a case that doesn”t pass the sniff test.

The case has received national visibility and will reflect on Lake County and its law enforcement/judicial system. At this point, the best thing the district attorney could do is to drop the case entirely, acknowledging that it was an unfortunate accident exacerbated by poor judgment.
