First, I would like to express my deepest sympathy, pity and sorrow to the family and friends of Lynn Thornton, an innocent victim, killed by an irresponsible, off-duty police officer.
Secondly, I want you to understand that the sheriff and district attorney in the county have taken it upon themselves to protect one of their own (good old boys rule No. 1) and tragically, they are blaming Lynn”s friend, Bismarck Dinius. I know that you are grieving her death and I”m sorry that these callous officials have never expressed any sympathy or remorse and actually they are refusing to say they are sorry, because to do so might make it seem like they are responsible. They are responsible … for a cover-up and conspiracy that will unfold in court. Please be patient.
Thirdly, justice will be served. It has been delayed and denied. Things have been this way for the last 15 years because Sheriff Mitchell is a control freak. I”ve been a victim also.
Fourthly, Bismarck Dinius, please, do not despair. Jury nullification: The jury will understand that you have been chosen to be the scapegoat. Don”t let it weigh on your mind, the expense and attorney fees. It will all be returned to you when the jury returns a not-guilty verdict. You will be vindicated. Remember that you have a lot of public support and it is the public that will decide this bogus case, brought on by government officials. You are not the aggressor. Don”t sweat it, there”s nothing to fear but fear itself. It”s the sheriff and DA who are sweating it. It”s easy for me to say, you are likely saying to yourself. I”ve been there. The jury is your friend. You didn”t hit Perdock, Perdock hit you. You were under sail. You are preferred over powerboats. Besides, Perdock was driving too fast to be under control. I”m surprised Perdock was not swept overboard by the impact. Was he wearing a seat belt?
I am criticizing Sheriff Rod Mitchell, not each and every police officer who works for the sheriff”s office. I detest that he is protecting his No. 2 in command, Russell Perdock. I am angered that in 2001 he allowed an illegal alien with an extensive criminal record and a deportation order to harass me and my wife for over a year. Sheriff Mitchell, why are you allowing these dangerous criminals to be free? Why are you protecting them? Why do you aid and abet them? I think you have lost sight of your mission. You certainly are not acting like a law enforcer. You are bringing a lot of controversy and shame on your office and your fellow officers, not to mention the loss of credibility and public trust. It is an irony that you state, “public safety is your highest priority!”
Sheriff Mitchell, you have “priors” for approving cases to be forwarded to the district attorney for prosecution … cases against your enemies. If you truly believed in the Constitution of the United States, why did you ask the Lakeport Police to confiscate my protest sign in 1994?
You are a “legend.” You are incorrigible. You are not safeguarding lives. You are not honest in thought and deed. You permit prejudices, animosities and friendships to influence your decisions. Your prosecution of criminals falls far short of being relentless.
