LAKEPORT ? With more than 50 pages of discovery for defense attorneys to read, the court continued the preliminary hearing Friday for two defendants in the attempted murder of a Lakeport man.
Joshua Wandry of Rohnert Park and Deborah James of Windsor will return to court 9 a.m. Friday at the Lake County Superior Court.
Wandry, James and Thomas Dudney of Fulton allegedly shot, tortured and hogtied Ronald Greiner, 49, on Oct. 20 at the Lakeport man”s home on South Main Street behind the Record-Bee building.
Wandry, 35, and Dudney, 59, are charged with attempted premeditated murder, aggravated mayhem, torture, simple mayhem, home invasion robbery in concert with another, first-degree burglary, assault with a firearm, assault with a blunt force object, assault likely to produce great bodily injury and serious battery.
Three of the charges carry life sentences. Special allegations that great bodily injury was inflicted and use of a firearm accompany the charges.
James, 46, is charged with attempted premeditated murder, home invasion robbery in concert with another and first-degree burglary.
Special allegations that a principal was armed with a firearm in commission of the offense accompany the charges. James was released on $100,000 bail Nov. 13.
James and Wandry pleaded not guilty to the charges and special allegations Nov. 13.
Dudney pleaded not guilty Nov. 23 to the charges and special allegations.
Komnith Moth, defense attorney for James, asked for a continuance Friday to read the 50 pages of new discovery he said he received 40 minutes before the hearing.
Wandry”s attorney, Stephen Carter, said he received 91 pages and a CD but he didn”t think he needed a continuance.
“I imagine if the discovery is offered by the people I would be able to keep up to speed,” Carter said.
Both attorneys and defendants agreed to a time waiver through Friday.
District Attorney Jon Hopkins said many of the discovery pages are lists of telephone numbers from phone records including contact between Wandry and Dudney and Dudney and James.
Both Wandry and Dudney remain in custody at the Lake County Jail as judges denied them bail.
Dudney is scheduled for trial Feb. 9 in the Lake County Superior Court at 255 N. Forbes St. in Lakeport. He will return to court Jan. 4 for an omnibus hearing, where lawyers are urged to make final motions before the trial.
