LAKEPORT — The Lake County District Attorney dismissed the attempted murder case Friday against a Sonoma County man and then refiled the case with 11 charges, including a gang charge and allegation.

Thomas Loyd Dudney, 59, of Fulton pleaded not guilty to the new set of charges and allegations and Judge Arthur Mann reset Dudney”s no-bail hold.

Dudney, Joshua Isaac Wandrey of Rohnert Park and Deborah Ann James of Windsor allegedly shot, tortured and hogtied Ronald Greiner Oct. 20 at the Lakeport man”s home on South Main Street behind the Record-Bee building.

Dudney and Wandrey, 35, are charged with premeditated attempted murder, aggravated mayhem, torture, home invasion robbery in concert with another, first-degree burglary, assault with a firearm, assault with a blunt force object, assault likely to produce great bodily injury, serious battery, simple mayhem and participating in the criminal street gang, the Misfits.

Three of the 11 charges carry life sentences. Special allegations that the crimes were committed for the benefit of a criminal street gang, that great bodily injury was inflicted and use of a firearm accompany the charges.

James, 47, is charged with premeditated attempted murder, home invasion robbery in concert with another, first-degree burglary and participating in the criminal street gang, the Misfits. Special allegations that the crimes were committed for the benefit of a criminal street gang and a principal was armed with a firearm in commission of the offense accompany the charges. James was released on $100,000 bail Nov. 3.

Dudney and two other codefendants, Joseph Henri Deshetres and Cheryl Ann Reese, allegedly conspired in November to intimidate a witness in the attempted murder case against Dudney.

Dudney, Deshetres, 62, of Santa Rosa and Reese, 56, of Lakeport are charged with intimidating a witness and participating in the criminal street gang, the Misfits. Special allegations that the crimes were committed for the benefit of a criminal street gang accompany the first charge.

The charges with special allegations carry a life sentence.

Dudney”s public defender, Doug Rhoades, said it appears the district attorney is trying to delay the case by dismissing it and refiling. District Attorney Jon Hopkins said “appearances can be deceiving” and that he wanted to add the gang charge and try Dudney”s case along with Wandrey and James.

Mann set the preliminary hearing for 9 a.m. Feb. 19 in Department two, the same time and date as Wandrey and James”s preliminary hearing.

In another department Friday with Judge Richard Martin presiding, Hopkins said he keeps receiving discovery in the case against Wandrey and James as the investigation continues.

Wandrey”s public defender, Stephen Carter, said he thinks it”s early in the case to consider a plea bargain.

Martin confirmed the preliminary hearing for Wandrey and James.

Deshetres, Reese and Dudney also appeared Friday in Mann”s court and set their preliminary hearing for 9 a.m. Thursday in Department three.
