CLEARLAKE — An arrest warrant signed by Honorable Judge Stephen Hedstrom was served on Java Express owner Eugene Robert Schwartz, 82, of Clearlake last week. Schwartz faces charges of rape.
Schwartz”s next court appearance is scheduled for 9 a.m. June 4 in Lake County Superior Court Department 4 in Clearlake.
According to District Attorney Edward Borg, who is prosecuting the case, a report was made to a mandated reporter alleging crimes of rape where a person is incapable because of a mental disorder or developmental or physical disability or giving legal consent and this is known or reasonably should be known to the person committing the act. An additional charge has been alleged against Schwartz as well wherein the act is accomplished against a person”s will by means of force, violence, duress, menace or fear of immediate and unlawful bodily injury.
Borg said the complaint was turned into the Clearlake Police Department (CPD) and that a charging decision was made by the DA”s Office based on the investigation of the CPD.
