LAKEPORT — A public defender handed off an attempted murder case Friday to another attorney, the day he was set to defend the Lakeport man in his preliminary hearing.
Attorney Doug Rhoades said he is also an attorney for a witness in the case against Daniel Beaty, 35.
Judge Andrew Blum assigned public defender Jacob Zamora to the case and relieved Rhoades.
Beaty allegedly shot Glenn Jenkins, 35, of Willits multiple times May 3 at a home in Lucerne.
Beaty is charged with attempted murder, assault with a firearm, burglary, felon in possession of a firearm, threats to commit a crime resulting in death and obstructing or resisting a public officer.
Zamora asked to have until Aug. 31 to review the case before the preliminary hearing he thinks might take two hours or longer.
Blum asked Beaty whether he would waive his right to have his preliminary hearing within 10 days and the defendant said he did not want to further waive time.
“I”m understanding I can”t do that because my attorney can”t be ready,” Beaty said.
Chief deputy district attorney Rich Hinchcliff said the options would be Aug. 17 or Friday, which is Aug. 13. The courtroom erupted in noise at the possibility of having a court date on Friday the 13th. Blum set the court dates for trial assignment at 8:15 a.m. Aug. 13 and Aug. 17 for his preliminary hearing.
On May 21, Judge Richard Martin denied Beaty”s request for bail and kept him on a no-bail hold at the Lake County Jail because he said Beaty allegedly shot Jenkins multiple times, has a lengthy rap sheet, could serve life in prison and performed poorly on parole in the past.
