LAKEPORT — On Monday, a Lakeport man again pleaded not guilty to charges including attempted murder and was set for jury trial in October.
Daniel Beaty, 35, pleaded not guilty to attempted murder, assault with a firearm, burglary and being a felon in possession of a firearm. Special allegations accompany the charges, including that Beaty caused great bodily injury, used a handgun and discharged that handgun causing great bodily injury. He is facing life in prison.
Beaty allegedly shot Glenn Jenkins, 36, of Willits multiple times May 3 at Tasha Cattani”s home on Third Avenue in Lucerne.
He is set to return to court 8:15 a.m. Oct. 4 for an omnibus motion hearing, where attorneys are supposed to address motions before trial. Beaty is also set for a trial readiness conference and settlement conference Oct. 13 and trial assignment Oct. 22. His trial begins 8:15 a.m. Oct. 26 with jury selection.
Judge Arthur Mann read the charges, allegations and Beaty”s rights to him Monday and reappointed the defendant”s public defender, Jacob Zamora.
On Aug. 17, Judge Andrew Blum found the prosecution presented sufficient evidence during the preliminary hearing to hold Beaty on the charges.
“He was angry,” Blum said of Beaty. “He was jealous of Mr. Jenkins and Ms. Cattani. He was going to kill Mr. Jenkins and he certainly made an attempt to do so.”
At the preliminary hearing, chief deputy district attorney Rich Hinchcliff dropped two other charges of threats to commit a crime resulting in death and obstructing or resisting a public officer, saying he didn”t present sufficient evidence for them. Blum agreed.
Blum ordered to keep Beaty on a no-bail hold based on the Probation Department”s recommendation, the seriousness and violence of the charges, Beaty”s record and the likelihood he would be a flight risk.
