LAKEPORT — A judge approved the delay of a motion hearing to exclude evidence Thursday in the attempted murder case against Thomas Dudney.

Judge Arthur Mann granted the request after both sides expressed a mutual interest to reschedule the hearing until the next week.

Doug Rhoades, Dudney”s public defender, requested additional time to review court documents and evidence that the defense had not yet received.

District Attorney Jon Hopkins supported the delay in part because it would allow a Sonoma County investigator, who was unavailable to appear Thursday, to testify in court.

Dudney and another man, Joshua Wandrey, are charged with 11 offenses, including attempted murder, torture, first-degree battery, and assault with a firearm, after allegedly shooting, torturing and hogtying Richard Grenier on Oct. 20, 2009.

The defense”s motion seeks to suppress evidence based on a lack of probable cause on the search and arrest of Dudney.

The hearing will reconvene Oct. 5 at 9 a.m.
