LAKEPORT — The defense attorney for a man accused of torture and attempted murder told a judge at the Lake County Courthouse Wednesday that he will ask the court for a continuance in a written motion to be submitted next week.
Stephen Carter, attorney for Joshua Wandrey, said that his client recently received funding for an expert witness and that he will need four to six weeks to prepare with the expert.
Carter said he would not divulge the nature of the expert testimony in open court Wednesday, allowing him to confidentially explore the possibility of using the expert”s opinions. Carter said he would file the motion by Oct. 20.
Wandrey and another man, Thomas Dudney, are charged with 11 felony counts, including premeditated attempted murder, first-degree battery and torture, in connection with an incident on Oct. 20, 2009 in which Lakeport resident Ronald Greiner was allegedly beat, shot, tortured and hogtied.
Wandrey and Dudney appeared before Judge Richard Martin Wednesday for a scheduled settlement conference. District Attorney Jon Hopkins reported no settlement agreement had been reached with either defendant.
The jury trial for Wandrey, and his co-defendant Dudney, is scheduled to begin Oct 26.
Wandrey and Dudney are next scheduled to appear in court Oct. 22 for trial assignment. Judge Martin said that if the continuance motion were filed, he would also address the motion on Oct. 22.
