LAKEPORT — A deputy district attorney Friday filed a written motion to dismiss the charges against Rohnert Park resident Joshua Isaac Wandrey, one of two men charged with attempted murder stemming from an Oct. 20, 2009 incident.

DDA Art Grothe said in the motion that “it is my professional opinion that there is currently insufficient evidence to proceed with this matter against defendant Wandrey.”

Wandrey, and co-defendant Thomas Loyd Dudney, face 11 felony charges, including first-degree battery, attempted murder, torture and assault with a firearm, in connection with an incident in which Lakeport resident Ronald Greiner was allegedly shot, tortured and hogtied.

The Lake County Sheriff”s Office arrested Wandrey on Nov. 4, 2009, about two weeks after Dudney was arrested as the first person charged for the incident.

“This is the correct thing to do,” Wandrey”s attorney, Stephen Carter, said in a statement Friday. Carter added that Wandrey “is pleased with that outcome and glad to put it behind him and move on.”

Grothe, who was assigned the case upon the end of former DA Jon Hopkins” term, said in his motion that he made the determination after reviewing “all reports, evidence and prior hearings conducted” as well as “following discussions with the witnesses, investigators and other personnel in this [DA”s] office.”

The investigation into Wandrey”s involvement is “continuing,” according to Grothe, and “if further evidence is secured, then the case will be re-evaluated upon its merits at that time.”

A judge would have to approve the dismissal motion, which is scheduled to be heard on Jan. 21 at 8:15 a.m. in Department 2.

No motion has been filed regarding Dudney”s case. The jury trial is scheduled to begin on Jan. 24.
