LAKEPORT — A judge Friday dismissed the charges against one co-defendant in the alleged torture and attempted murder of a Lakeport resident in October 2009.

Judge Arthur Mann ruled that the 11 felony charges against Joshua Isaac Wandrey, of Rohnert Park, be dismissed pursuant to a prosecution motion.

Deputy District Attorney Art Grothe filed a dismissal motion on Jan. 14, writing in the motion that “there is currently insufficient evidence to proceed with this matter against defendant Wandrey.”

Wandrey had been accused of participating in an Oct. 20, 2009 incident in which Ronald Greiner was allegedly shot, tortured and hogtied.

The investigation into Wandrey”s involvement is “continuing,” Grothe wrote in the motion, and “if further evidence is secured, then the case will be re-evaluated upon its merits at that time.”

Though Wandrey no longer faces charges in Lake County, he remains held in the Lake County Jail because of two warrants against him out of Sonoma County, according to Capt. James Bauman, of the Lake County Sheriff”s Office.

The warrants stem from charges of possession of a controlled substance and misdemeanor possession of marijuana, Bauman said. Wandrey will be transported to Sonoma County sometime during the next week, Bauman said.

Thomas Loyd Dudney, who had been Wandrey”s co-defendant, still faces 11 felony charges for his alleged role in the incident. The charges against Dudney are attempted murder, causing permanent disability, mayhem, torture, robbery, burglary, assault with a firearm on a person, two counts of assault with a deadly weapon other than a firearm, battery on a person causing serious bodily injury and participating in a criminal street gang.

The jury trial is scheduled to begin Tuesday at 8:15 a.m. in Department 2.
