LAKEPORT — A judge Friday morning granted a continuance motion to delay the start of the preliminary hearing for a Clearlake Oaks man accused of killing his brother.
Alberto Alejandro Montes, 26, is charged with murder for allegedly shooting to death his brother, Rafael Montes, at an Elem Indian Colony home in October 2009.
The preliminary hearing was scheduled to start Friday, but the defense requested a short continuance because Alberto Montes”s attorney, Richard Petersen, is recovering from an illness. Judge Andrew S. Blum scheduled the estimated daylong hearing for April 28 at 9 a.m. in Department 3.
