LAKEPORT — A judge Tuesday continued the jury trial of Rowland James Mosser after learning there would be no settlement in the embezzlement case against the former senior center executive director.
Judge David W. Herrick presided over Tuesday”s settlement conference. Attorney Gary Luck represented the Lake County District Attorney”s Office and attorney Mitchell Hauptman represented Mosser.
Mosser faces two felony counts of embezzlement and two felony counts of grand theft exceeding $400 for allegedly stealing money from the Lucerne Alpine Senior Center during a seven-month period in 2005.
Mosser, who served as the center”s executive director from January 2002 until resigning in August 2005, has pleaded not guilty to all charges.
Both attorneys said Tuesday that Mosser turned down a plea offer, under which he would have faced no jail time in exchange for pleading guilty to misdemeanor grand theft, being placed on three years probation, completing community service hours and paying restitution to the senior center.
Upon hearing there would be no settlement, Herrick granted the defense motion to continue the trial start-date from mid-July to mid-October.
Herrick scheduled the jury trial to start Oct. 12, with a trial assignment date of Oct. 7 and a trial readiness conference date of Sept. 19.
