LAKEPORT — A judge Monday granted a defense motion to continue the trial of Robby Alan Beasley, who is accused of murdering a Maine couple in Lower Lake last year.

Beasley, 30, is charged with two felony counts of murder and one felony count of being a convicted felon in possession of a firearm in connection with the deaths of Frank Maddox, 32, and Yvette Maddox, 40.

The partially decomposed bodies of the couple were found in March 2010 at the bottom of an embankment off of Morgan Valley Road in Lower Lake and subsequent autopsies determined Frank and Yvette Maddox died because of gunshot wounds to the head, according to Lake County Sheriff”s Office investigators.

Beasley”s attorney, Stephen Carter, filed a continuance motion, requesting additional time to explore a potential expert witness and to conduct other interviews. The prosecution offered no opposition to the request.

Judge David W. Herrick rescheduled the jury trial, which was set to start in early October, to instead begin Dec. 14. Beasley will next appear in court on Nov. 28 for a pre-trial hearing.

Beasley”s co-defendant, Elijah Bae McKay, also appeared before Herrick Monday for a scheduling matter.

The two defendants” cases are on different tracks as McKay, 29, has yet to have a preliminary hearing. McKay testified as a people”s witness during Beasley”s preliminary hearing in January and the prosecution is expected to call him during Beasley”s jury trial.

Herrick continued McKay”s preliminary hearing scheduling to Nov. 29.
