CLEARLAKE — A judge Tuesday set a January trial date for a Clearlake Oaks man accused of killing his brother nearly two years ago.
Judge Stephen O. Hedstrom scheduled the jury trial of Alberto Alejandro Montes, 26, to begin on Jan. 25, according to deputy district attorney Sharon Lerman-Hubert.
Montes is charged with murder and two special allegations, use of a firearm and discharge of a firearm, for allegedly shooting to death his brother, Rafael Montes, in mid-October 2009.
Montes, who has pleaded not guilty to all charges, remains in custody at the Lake County Hill Road Correctional Facility. He is next scheduled to appear in court on Nov. 8 for a motion hearing.
