CLEARLAKE — A Clearlake Oaks man pleaded guilty earlier this month to voluntary manslaughter in connection with his brother”s death and is set to be sentenced next week.
Alberto Alejandro Montes, 26, had faced a murder charge and two special allegations for the October 2009 shooting-death of his brother, Rafael Montes. A jury trial was set for January.
However, on Nov. 8 Judge Stephen O. Hedstrom accepted Montes” plea to the lesser count, according to court records. Montes is set to return to Hedstrom”s Clearlake courtroom on Dec. 6 for sentencing. Both parties stipulated to a prison term of 11 years, the upper limit for voluntary manslaughter, according to Deputy District Attorney Sharon Lerman-Hubert.
Montes has remained in custody since being arrested after the incident more than two years ago.
