COBB MOUNTAIN — Unreturned calls and checks he couldn”t cash prompted Delbert Adams to file a complaint against Hobergs Development LLC in September 2011, he said Thursday afternoon.

“It really messed me up for awhile financially,” Adams said.

Adams provided documentation from the State of California Department of Industrial Relations to Lake County Publishing confirming a May 31 judgment in the amount of $10,052.62.

Adams was a construction laborer at the Hoberg”s Resort site from Aug. 8, 2011 to Oct. 5, 2011. The judgment states that Adams was issued three paychecks that were not negotiable when he received them.

One check did not show a payer and was absent an itemized deduction statement. The next check was drawn on the Bank of America account of Lava Entertainment Holdings, LLC.

The third check, returned by the bank for insufficient funds, was drawn on an account from Kerner Entertainment Technologies, LLC, and the name Lava Entertainment Holdings, LLC was on the bottom of the check.

The judgment names the defendant in the action as Hobergs Development, LLC, a limited liability company, doing business as Hobergs Club Resort.

An email statement from Hoberg”s manager Dan Ethan Nelson received on Thursday night stated:

“Delbert refused to receive his check and get paid from two of our people that worked for us that we can proven (sic). His total pay owed was less than $400. We made offers to him for a reasonable amount and he did not accept. If he would be reasonable with the request, then we would have no problem taking care of it.”

Adams said Nelson, whom he has never seen in person, made numerous promises to pay, but did not deliver.
