Middle Creek Project still on says engineer

LAKE COUNTY — Judge Wright L. Callender, of Glenn County, submitted a memorandum of decision stating that two resolutions concerning Middle Creek Flood Control Project, passed July 8 and July 17, were void. Judgement on this has not been handed down, but in normal procedure when it is the two resolutions then will be void.

His decision was based on two correctable procedural errors involving a notice sent out by the county clerk and statements of the board which Callendar said denied full hearing.

Outlawed, when judgement is handed down, will be the assurance of maintenance of the $600,000 Middle Creek Flood Control Project.

Howard Hitchcock, assistant chief engineer of the state reclamation board, told the Press-Record and Bee that there would be no slowing down of the project.
