LAKEPORT >> The case against District 5 Supervisor Rob Brown, his wife Kim and their bail bonds company has ended with all charges being dismissed Wednesday.

Steven Brown, attorney for the Browns, stated that Rob and Kim Brown “are pleased with the outcome and are grateful to finally be cleared of all of the false allegations.”

The case involved an alleged altercation that occurred between Brown and plaintiffs Robert and Jan Sanders in 2012, when Brown went to serve civil paperwork at a house located on Buckeye Street in Clearlake.

On Aug. 21, 2012, Clearlake Police responded to a reported assault around 9 p.m. that followed Brown’s attempt to serve.

According to Steven Brown, the Sanders’ used a deed of trust on the property to secure a bail bond for their son in January of 2009.

“After the Browns spent several years attempting to collect the debt owing for the bail premium owed by Robert and Jan Sanders, the Sanders’ refused to pay,” Steven Brown stated. “As a result … the real property secured by the deed of trust was foreclosed on and the Browns subsequently became the owners of the property.”

It was during the serving of paperwork regarding ownership and rent that the alleged incident occurred, resulting in multiple claims being filed.

According to court documents, Robert Sanders “sternly grabbed … Brown by the arm and spun him around.” That is when Rob Brown punched him one time in self-defense, Steven Brown said.

However, the Sanders’ claimed Rob Brown was acting in a “hostile and aggressive manner.”

In May, all but two of the 14 original claims were dismissed with a sustained demurrer without leave to amend due to lack of any facts to support the causes of action.

Claims included elder abuse, fraud, battery, assault, trespassing, intentional emotional distress, breach of contract and animal cruelty.

Assault and battery remained a part of the case until it went to trial Wednesday, when the Sanders’ requested the remaining causes of action be dismissed.
