LAKEPORT >> A Jury Trial has been set in the matter of the People vs. Ricky Roberts, Sr. for October 13 at 8:15 a.m. in a department to be announced. Deputy District Attorney Edward Borg was in court on his Arraignment Information Motion, which was given to the court appointed Defense Attorney, Mitchell Hauptman.
While five counts have recently been dismissed, there are six counts which still remain. The remaining counts include Convicted Felon In Possession Of A Firearm, Possession For Sale Of A Controlled Substance, Person Prohibited in Possession of Ammunition, Possession For Sale Of A Controlled Substance, Plant/Cultivate/Harvest Marijuana and Possession of Marijuana For Sale.
Ricky Roberts, Sr., 51, of Oakland, California was arrested in May 2016 for kidnapping, sexual assault and drugs with the kidnapping and sexual assault charges recently being dismissed. Clearlake Police officers responded to the 15100 block of Lakeview Avenue for the report of a battery.
Robert’s criminal history shows him to be a convicted felon with prison term served for the sale of narcotics, and under those terms, Roberts is not allowed to own or possess firearms or ammunition. Clearlake Police seized a firearm and ammunition. Roberts was also found to be in possession of approximately $5,800 in U.S. currency of numerous denominations.
Roberts was present and in custody in court July 6. The Court informed Roberts of the Information filed against him and of the charges contained therein. The Court advised Roberts of his constitutional rights, the right to counsel, and that if counsel is appointed an order for reimbursement of costs could be made. Formal reading of the Information and advisement of rights was waived.
Roberts was given California Department of Justice, Bureau of Firearms, Forms BOF110-Power of Attorney for Firearms Relinquishment, Sale or Disposal-Declaration and Firearms Prohibiting Categories. Roberts was also fingerprinted per Form CR-100.
Bail was argued and is reduced to $170,000 for reasons stated in the record. Roberts enters a plea of not guilty to all counts and denies the special allegation(s). The defendant also enters a general time waiver.
