LAKEPORT >> Nine Green appeared with Defense Attorney Robert Spangler at the Lake County Superior Courthouse in Lakeport, waiving his right to a preliminary examination.
Green is charged with two counts of Threats to Commit Crime which will Result in Death or Great Bodily Injury, Threats to any Elected Public Official, Willful and Malicious Harassment to Another Person and 34 counts of Violation of Protective Order. The charges stem from a number in incidents, including Green spreading manure on the District Attorney’s office.
The People are prepared to go forward with this case, as members of the Attorney General’s Office were present in court.
Judge Arnold D. Rosenfield presided over the scheduled Preliminary Examination while explaining to Green the Preliminary Examination rights he had surrendered in open court.
Judge Rosenfield asked Green, “Do you understand the rights you are giving up at this time?”
“Yes sir. I do,” responded Green.
Judge Rosenfield ordered the Attorney General’s Office to file an Information in court, alleging charges as outlined in the Information with any Amendments indicated.
Defense Attorney Spangler reminded Judge Rosenfield that Green is currently out on bail, with his bail being enhanced from $20,000 to $75,000. Spangler encouraged the Court to reduce Green’s bail, since Green has given up his internet connection with no recent engagement of anti-social conduct.
The Attorney General’s understands the motion to revoke Green’s bail, but reminds the Court of the thousands of pages of Discovery pertaining to this case.
Judge Rosenfield did reduce Green’s bail to $25,000, but also indicated that if there are any problems whatsoever, he will enhance Green’s bail to over $75,000. Search and seizure terms remain in effect.
This matter is set for an Arraignment on an Information on Sept. 16 at 10:30 a.m. in Department 2. The defendant is ordered to be present.
