LAKEPORT >> David Paul Sander was sentenced to more than two years in state prison for the 2016 theft of $14,000 in property.

Judge Andrew Blum found the 51-year-old guilty of second degree burglary, a felony charge. He set the punishment at 16 months. However, the court applied California’s three strikes law, allowing the sentence to be doubled on a second strike offense.

Sander is a repeat offender with a prior strike.

In August of 2016, Lake County Sheriff’s Office detectives linked Sander to the theft from a home on Soda Bay Road in Lakeport. The Clearlake Oaks resident was identified with the help of video surveillance cameras located on the Soda Bay property.

Law enforcement officers arrested Sander at his home on Aug. 10 of last year.

Judge Blum presided over the sentencing hearing at Lake County Superior Court as Defense Attorney Thomas Quinn requested that the matter be set for a restitution hearing.

Sander waived his presence for the restitution hearing.

Sander is also sentenced to the following financial obligations:

Restitution fine of $900 is imposed with an additional restitution fine of $900, being stayed unless parole is revoked.

A $10 fine plus a penalty fine of $31 with a Court Operation Assessment of $40, Criminal Conviction Assessment of $30, Criminal Justice Administrative Fee of $90, while restitution is reserved for the victim in this matter.

The total term imposed for the defendant is 2 years and 8 months and he is awarded 9 days of credit for time served and 8 days of conduct credits, for a total of 17 days credit.

Sander was remanded to the custody of the Lake County Sheriff in order for him to be delivered to California Department of Corrections and Rehabilitation.

Preliminary hearing set in Jelks matter

Lawrence Clayton Jelks, 69, was not in custody and present in court for his Disposition/Setting Hearing.

Jelks had been located in February and arrested after he had failed to register as a sex offender, while the Lake County Sheriff’s Office issued a warrant for Jelks.

Law enforcement officials received a number of tips from the public and police in Clearlake took him into custody as Jelks was transported to the Lake County Hill Road Correctional Facility and booked on the arrest warrant for failing to register as a sex offender.

His bail had been set at $35,000, but after making bail — Jelks is now out of jail.

Judge Stephen Hedstrom presided over the matter as the Preliminary Hearing has been set for April 17 at 8:15 a.m. in Department 3. The defendant is ordered to be present.
