The Jury Trial of the People vs. Nine Green, set for January, has now been continued to June 6. The latest in a series of delays was approved after Green requested to represent himself.
Green is charged with two counts of Threats to Commit Crime which would result in Death or Great Bodily Injury, Threats to an Elected Public Official, Willful and Malicious Harassment to Another Person and 34 counts of a Violation of Protective Order.
The charges stem from a number of incidents, including Green allegedly spreading manure on the District Attorney’s office.
During a recent hearing, Judge Thomas Maddock was present, as was Nine Green, but Deputy Attorney General Geoffrey Lauter and Defense Attorneys Charles Applegate and Gabriel Quinnan were present by telephone.
The Court reviewed the file, including the substitution of counsel, and Green confirmed he is releasing both attorneys, requesting to represent himself.
Green completed a form — “Declaration, Finding an Order Regarding Self-Representation in Criminal Case” — and the court ordered the declaration be filed.
The attorneys who had represented Green were relieved and ordered to turn over any and all discovery in their possession to Green.
Lauter requested Green not email the witnesses or him as he is willing to respond to written letters to any issues. The attorney general also asked the restraining order to remain and for Green to have an investigator present if the parties agree to meet.
The Court decided that any restraining orders will remain in effect.
The Pre-Trial Conference has been set for May 24 at 9 a.m. with the Trial Assignment set for June 1 and the Jury Trial set for June 6 at 8:15 a.m. in a department yet to be announced.
