CLEARLAKE >> Two Clearlake men are under investigation after one shot at the other for attempting to enter a residence late Monday night.
Clearlake Police Department Sgt. Rodd Joseph said Mayfield Herbert Montes, 21, was banging on the window of a couple’s home in Southshore Mobile Home Park, located on 5725 Old Highway 53.
Montes was attempting to enter the residence, claiming to own property inside, Joseph explained.
Clearlake Police officers were en route when dispatch received updated information that an adult male resident of the home — whose name is being withheld — claimed to have shot at Montes.
The 21-year-old fled the residence on foot. He then walked to a home in the 5500 block of Cottage Ave., where police and medical personnel contacted him.
Montes was found suffering from a single gunshot wound to his lower abdomen. An ambulance transported him to Adventist Health Clear Lake hospital, then taken by helicopter to an out-of-county trauma center.
“Montes is still hospitalized in stable condition and is expected to survive his injuries,” Joseph said.
The resident was found in lawful possession of the firearm which was seized under the investigation. Joseph said that physical evidence and uninvolved witness statements support the resident’s claim that he fired in self-defense to protect him and his wife, who was also inside the home at the time of the incident.
“He was not arrested at this time, and neither he nor his wife suffered any injuries during the incident,” added Joseph.
Tthe Lake County District Attorney’s Office received the case for review of charges against both the resident and Montes.
