LAKEPORT— A special municipal election is to be held by the City of Lakeport on Nov. 8, 2022, at which there will be submitted to the voters registered in the South Lakeport Annexation project area the following proposition:
“Shall the order adopted on March 30, 2022, by the Local Agency Formation Commission of Lake County ordering the annexation to the City of Lakeport of the territory described in that order and designated “City of Lakeport Annexation to the City of Lakeport (LAFCO file 2019-0006) (South Lakeport Annexation)” be confirmed?”
General Description of Affected Territory Boundaries: The South Lakeport Annexation project area is generally described as the area from (and including) 2325 South Main Street to (and including) 96 Soda Bay Road. The territory proposed to be annexed is fully described in Exhibits A and B of LAFCO Resolution 2022-0006, which may be found on the Elections page of the City of Lakeport website at https://www.cityoflakeport.com/elections/index.php or may be requested from Office of the City Clerk, City of Lakeport, 225 Park Street, Lakeport, CA.
Primary arguments:
The City Clerk has determined and the City Council hereby establishes July 25, 2022, at 5 p.m. as the deadline for submission to the City Clerk of direct arguments in favor or against the proposition.
All primary arguments may not exceed 300 words in length and shall be accompanied by the printed name(s) and signature(s) of the author(s) submitting it, in accordance with Article 4, Chapter 3, Division 9 of the Elections Code. The argument may be changed or withdrawn until and including the above date, after which no arguments for the proposition may be submitted to the City Clerk. All primary arguments submitted shall comply with Elections Code Section 9600 et seq. If more than one argument for or against the proposition is received, the City Clerk shall select the argument for printing and distribution to the voters giving preference and priority in accordance with Elections Code section 9287.
The City Council hereby authorizes Mayor Mattina to prepare and file the primary written argument on behalf of the City Council in support of the proposition.
Rebuttal arguments:
The City Clerk has determined and the City Council hereby establishes August 4, 2022, at 5 pm as the deadline for submission to the City Clerk of rebuttal arguments in favor and against the proposition. The author or a majority of the authors of an argument relating to the proposition may prepare and submit a rebuttal argument or may authorize in writing any other person or persons to prepare, submit, or sign the rebuttal argument. The rebuttal argument shall not exceed 250 words and shall not be signed by more than five (5) persons that appear therewith. All rebuttal arguments submitted shall comply with Elections Code section 9167 and Government Code section 57147.
Impartial analysis:
The City Clerk is directed to transmit copies of Resolution 2866 (2022) to the Executive Officer of Lake LAFCO. Pursuant to Government Code section 57144, within five days after the special election is called, the Executive Officer of Lake LAFCO shall submit to the LAFCO Commission for its approval or modification, an impartial analysis of the proposed annexation. Lake LAFCO shall file the approved impartial analysis with the City Clerk no later than August 4, 2022 at 5 p.m.
The election shall be consolidated with the statewide election and conducted in accordance with the requirements of the Cortese-Knox-Hertzberg Local Government Reorganization Act and the California Elections Code. The required vote for approval of the annexation shall be more than 50% of the valid registered voter votes cast in the election. Any registered elector within the affected territory may vote only in the special election precinct in which the voter resides. Voters are entitled to one ballot and one vote.
The South Lakeport Annexation was initiated by the City of Lakeport. The City’s statement of reasons for the proposed annexation are set forth in Lakeport Resolution No. 2725 (2019), located on the City’s website https://www.cityoflakeport.com/community_development/annexation_document_center.php. LAFCo shall not record the Certificate of Completion until the annexation is approved by the registered voters and all terms and conditions stated in Resolution 2022-0004 are satisfied. Copies of Resolution 2022-0004 can be requested from the City Clerk or found on the Elections page of the City of Lakeport website.
The polling places shall be set by the Lake County Registrar of Voters, and all ballots cast in said election will be counted at a location set by the Lake County Registrar of Voters.
