Antonio Thomas Magalhaes, 37, of Nice, was in custody as he recently appeared at his sentencing hearing – after being convicted of sexual assault in March.
The Court read and considered the report and recommendation of the Lake County Probation Department.
Probation was denied and it was the judgement of the Court that the defendant is guilty of a felony violation PC261(a)(3) (rape/drugs used to prevent resisting). As punishment the defendant is to be imprisoned in state prison for six years.
He is also ordered to pay restitution fines of $600. Restitution is reserved for the victims through CW (Trafficking & Crime Victims Assistance Program) and the Victim Compensations Board.
The defendant was awarded 610 days of credit for time served and 610 days of conduct credits; totaling 1,220 days credit.
The defendant was remanded to custody of the Lake County Sheriff and delivered to the California Department of Corrections and Rehabilitation.
Magalhaes was initially charged with assault with intent to rape in committing 459 (burglary), sodomy by use of force, two counts of burglary, three counts of rape by force/violence/duress/menace or fear, assault with intent, false imprisonment, rape/drugs used to prevent resisting, rape: victim unconscious of nature of act and inflict corporal injury on spouse with prior.
The charges stem from incidents that occurred in 2018 and 2019, which involved two victims.
During a jury trial last year it was determined the defendant sexually assaulted and beat one victim on several occasions, while the other victim was raped when she was unconscious.
Investigation of this matter was conducted by detectives from the Mendocino County Sheriff’s Department, Lake County Sheriff’s Department and Lake County District Attorney’s Office.
Attempted murder suspect retains new counsel to represent him in court
An 18-year-old Kelseyville man facing attempted murder charges and attempted robbery was in custody; recently appearing at the Lake County Superior Court in Lakeport for further proceedings.
Jesse Gonzalez has retained Brian Allen Ford as his counsel and the Court relieved Sterling Thayer, Jr. as Counsel.
The master calendar call hearing was set for Friday with the preliminary hearing reset for May 17.
During a hearing last month, the matter was set for further proceedings with the appearance of new counsel and the possible resetting of the preliminary hearing.
The defendant faces attempted murder charges, assault with a firearm on person, causing permanent disability, mayhem, attempted robbery and attempted carjacking.
The charges stem from an incident in March when the Lake County Sherriff Deputies were dispatched to the Sentry Market in Nice for a reported gunshot victim.
When deputies arrived on the scene, they located an adult male victim who suffered from a gunshot wound to the arm.
The victim was treated for a non-life-threatening gunshot wound at a local hospital.
Deputies successfully located the scene where the incident took place – 4400 block of Lakeview Drive, Nice.
The Lake County Sheriff’s Office Major Crimes Unit responded to the scene and took over the investigation, identifying a suspect in the case tracking him in Lakeport.
Authorities served a search warrant at a residence on Red Feather Lane in Lakeport, gathering evidence related to the shooting. The suspect was located and arrested.
The defendant was booked into the Hill Road Correctional Facility where he remains in custody with bail set at $2 million, twenty thousand.
