LAKEPORT— A Colusa man who had reportedly shot at transients with an assault rifle in Clearlake Oaks was in custody and present at the Lake County Superior Court in Lakeport for his sentencing hearing.

It was the judgement of the Court that the defendant, Glenn Michael Prasad, 36, of Colusa, is guilty of a felony violation of assault with firearm on person.

The defendant will serve a period of 364 days in the Hill Road Correctional Facility with credit for 126 days previously served and 126 days of behavior credit, making a total of 252 days credited.

The defendant also signed a Johnson Waiver for 364 days. A Johnson Waiver is a waiver of the defendant’s right to have any custody credit applied toward his sentence.

The Court read and considered the Report and Recommendation of the Lake County Probation Officer.

The defendant was also placed on formal probation for a period of three years, which is subject to a variety of terms and conditions.

The defendant will report in person to the Lake County Probation Department the first Friday following his release from custody.

Some of those terms and conditions include that the defendant shall be under the supervision of the probation officer, abide to direction of the probation officer between the 1st and 10th of each month on forms provided by the probation officer, report any change of address within five days, complete twenty (20) community service hours as directed by the probation officer and more conditions.

Earlier this year, during a settlement conference, the defendant entered a no contest plea to the felony charge (Count 1) of assault with a firearm on person and admitted to the special allegation.

A no contest plea means the defendant agrees to accept a conviction to the charge without admitting to factual guilt.

On motion of the People, the Court orders the balance of the information (other charges) dismissed in the interest of justice.

The Court accepted the defendant’s plea and advised him that he is prohibited from owning, purchasing, receiving, possessing or having under his custody or control any body armor, firearms, ammunition and ammunition feeding devices, including but not limited to magazines.

At that time the jury trial was vacated.

Last year the defendant entered a not guilty plea to all counts and appeared for his preliminary hearing as the Court ordered the defendant be held to answer to the charges.

Defense counsel, Lawrence Larocca, present by remote appearance, requested the defendant be released on his own recognizances (‘OR’ -allows a defendant to be released from jail without having to post bail with their promise to appear in court and to follow their terms of release).

In October of last year the defendant entered a not guilty plea to all charges and he denied the special allegations.

The court relieved Sterling Thayer Jr. as counsel as the defendant retained Mari Titus as his counsel.

The defendant has been charged with an assault with firearm on person and two counts of possessing any assault weapon.

The charges stem from an incident last month when Lake County Sheriff’s Office were dispatched to Oak’s Red & White Store in Clearlake Oaks after a report that a male subject had shot at transients in the vicinity of the market with a rifle.

It was reported that no one was injured. A vehicle description of the shooter was provided by witnesses and deputies successfully located the vehicle at a residence on Shoreview Drive in Clearlake Oaks.

The suspect was located inside the residence.

A search warrant was secured by detectives, which resulted in the discovery of an unregistered AR-style rifle similar to the description witnesses had provided to authorities.

Authorities took Prasad into custody and he was transported to the Lake County Correctional Facility.

The defendant remains in custody at the Hill Road Correctional Facility.
