LAKEPORT >> A Lakeport man who resisted arrest and assaulted two officers was in custody and recently appeared at the Lake County Superior Court in Lakeport for his sentencing hearing.
During the hearing the Court received defendant’s exhibits into evidence, which included several photos, fictitious name statement, application for original contractor’s license, a declaration of the victim and Ohlhoff Recovery Program Information to name a few.
The defendant, Patrick James Davies, 35, waived formal arraignment for sentencing.
The Court read and considered the report and recommendation of the Lake County Probation Officer and documents presented from Bank of America regarding possible identity theft of Patrick James Davies.
The Court heard oral argument from defense counsel as to the defendant’s application to be granted probation. Probation was denied.
The Court made the following findings:
It was the judgement of the Court that the defendant is guilty of a felony violation of PC 245(a)(4) (assault with force likely to produce great bodily injury) and that as punishment he be imprisoned in state prison for a term of 3 years.
It was further judgment of the Court that the defendant is guilty of a misdemeanor violation of PC 243(e)(1) (domestic battery) and that as punishment he be imprisoned in state prison for a term of 1 year.
The Court has also found the defendant guilty of 3 felony violations of PC 484b (money received for construction purposes and failing to use it for intended purposes, diverting it and using money for other purposes).
The final violation is a misdemeanor of BP 7028(a) from the California Business & Professions Code, which is contracting without a current and valid license.
The total term imposed for the defendant is 5 years. The defendant has been awarded 90 days of credit for time served and 88 days of conduct credits for a total of 178 days credit.
Financial obligations were also ordered in this case in which the defendant is ordered to pay restitution fines totaling $3,000. Restitution is reserved for the victims, including Lakeport Police Officers Shaun Johnson and Juan Altamirano. The female victim will remain unnamed.
The defendant has been remanded to the custody of the Lake County Sheriff to be delivered to the California Department of Corrections and Rehabilitation. The arrest and charges of the defendant stem from an incident in March when Lakeport Police Officers were dispatched to a residence in the 900 block of 11th Street.
Upon arrival at the scene, officers located an adult female who had apparent injuries, and authorities determined that she was a victim of domestic violence. The victim was removed from the scene and taken to the hospital.
The male suspect was identified by officers as Patrick Davies. When officers initiated the arrest of Davies, he resisted and assaulted two officers then retreated into the house. Negotiations ensued as additional officers responded.
After a four-hour standoff, the defendant surrendered to Lakeport Police Officers. The defendant was taken into custody and booked into the Lake County Jail. There was a separate matter in which the defendant had been previously charged with several counts of contracting without a license and diversion of funds intended for services. The defendant has been sentenced in that matter as well.
